An appeal has been launched to urge motorists, caught driving in part of the city's bus lane network, to appeal their fines after one man's successful appeal.
Peter Upsher, from Saltford, is one of a number of people who have been caught on camera using the bus lane on Wellsway, as they turn left onto the road from Rosemary Lodge vets.
He is now warning other people to be careful when exiting the surgery, after fighting his case and escaping a £60 fine. However, Bath and North East Somerset Council has not been able to tell Mr Upsher – or The Bath Chronicle – its reason for overturning the fine.
As drivers approach the exit junction from the vets they have to turn left onto Wellsway. It has two lanes, the left-hand side lane being the bus lane.
Mr Upsher said: "There are no markings to feed you straight out of the junction to the right-hand side lane.
"Naturally you take up the left-hand lane and I had to do this to gain speed before moving over to the right-hand lane and therefore out of the bus lane.
"Other people may have been forced to pay a fine but they should appeal like I have. It is ridiculous."
CCTV shows Mr Upsher driving in the bus lane on July 9, although nobody has been able to say why his case was dropped, leading to a call by Mr Upsher for a change in the road markings.
Rosemary Lodge press manager Helen Bigtadike said the vets has been aware of the issue for some time.
"We are aware other people have been fined, sometimes not knowing the bus lane is in place. Maybe the markings are not clear enough.
"We welcome the council to do something to help people be more aware of the bus lane."
Chapter five of the Traffic Signs Manual, available on the government website, only advises local authorities on how to lay out road markings depending on the road.
The council has responded to people's concerns regarding the junction.
It said: "All vehicles are expected to move into the main carriageway as soon as exiting any road or private entrance where a bus lane is in place. The bus lane should not be used as a slip road to gain road speed before entering the traffic flow."
It would not comment on Mr Upsher's case but has been in discussion with Mr Upsher himself, although no reason has yet been given.
