Dealing with a loved one's affairs when they can't

When you realise that an elderly parent or family member is reaching a point where they can no longer manage their affairs, it is often devastating for everyone involved.

Trying to work out what to do for the best can make a difficult time even more stressful.

We are one of very few law firms with a dedicated team of specialists appointed by the Court of Protection to act as deputy to people who no longer have the mental capacity to make their own decisions.

In our role as deputy, we work closely with families like yours to ensure people without mental capacity are properly provided for. You may be surprised by the extent of our involvement – from ensuring homes are adapted and cost-effective to run to appointing carers and ensuring benefits and other entitlements are protected.

Our role may also involve applying for a statutory will if there isn't an existing will or the current will is no longer representative of the person's circumstances.

This can be a huge relief to family members who may feel unqualified or unable to take on these tasks by themselves.

We will walk you through the process so that you feel informed and involved at every stage.

Withy King also deals with Lasting Powers of Attorney, trusts, estate and tax planning and wills.

For a private discussion about these issues or any other family matter, please contact Holly Mieville- Hawkins or Maria Meek at Withy King on 01225 730100 or email maria.meek@withy king.co.uk.
